This morning, William Shane Downs, age 43 and formerly of Borger, pled guilty to three counts of Indecency With a Child by Sexual Contact which occurred between May of 2000 and January of 2003 in Borger. Following Downsâ€™ plea, Judge David Gleason, 316th District Court Visiting Judge, sentenced Downs to twenty years in the Texas Department of Criminal Justice. Further, Downs was ordered to register as a sex offender upon his release from prison for the remainder of his life. Downs was indicted for these offenses by a Hutchinson County Grand Jury in March of 2011.
The three charges for which Downs pled guilty are all second degree felonies with a maximum punishment range of twenty years. Due to the nature of the charges, Downâ€™s will not be eligible for parole for 10 years and could serve the entire 20 year sentence. Pursuant to Downsâ€™ plea of guilty, the State abandoned 1st degree and 3rd degree sexual offenses for which Downs had been indicted. District Attorney Mark W. Snider prosecuted the case on behalf of the State. Borger attorney Curt Brancheau represented Downs.
As part of the plea agreement, Downs waived his right to have his case tried before a jury, and he waived his right to appeal these cases. Snider is very satisfied with the disposition of this case and is pleased that the victim will not have to testify before a jury.
